I have come across a no of cases where manufacturers refuse to entertain products under warranty by stating misuse or physical damage. How can a consumer take up such issues with the concerned departments? more
I can see that there everyone is effected in one sense or the other due to the malpractices adopted by the brand owners in honoring warranty claims. Government has setup consumer forums but there is no authority to monitor the speed and quality of the disposals. If the consumer courts act fast and effectively, it is guaranteed that most of the issues will be resolved without the need to even bother the courts since the manufacturer will not like to pick the additional litigation cost in addition to the compensation paid to the consumer. In reality the situation is reverse, manufacturers exploit the state of consumer courts to harass consumers even more by dragging the litigation into years and making the consumer make repeated round to the courts. Warranty becomes void in the event of mishandling and physical damage. Even if the seal of the company is broken and/or the article is opened by other than the company authorised mechanic, the warranty becomes void and in such cases even the Consumer Court or Civil Court can help. more
Consumer forums are in a pathetic state of affairs. i have already filed more than 3 cases with them but they do not care or wish to resolve them on priority. takes years for a simple decision. and also one has to pay for the lawyers fee for a claim of few thousand rupees more
Send a Warning / Notice to the defaulting Company, and also file an F.I.R. against them in your local police thana. If the Company does not act within the time ( normally 2 weeks) given to them by you, then file a complaint- application against them, with all the relevant documents (including a copy of your Notice to them, and your F.I.R.), before the State Consumers Forum/Court. The procedure is simple, cheap and quick. You don't need to engage a lawyer, and can go about it yourself. Ask the Court for Costs and also Compensation for 'mental harassment'. GOOD LUCK! more
Thanks for the advise Maya , but the local police station would never file an FIR for a warranty dishonor case. I tried that as well , even wrote to the commissioner of police a couple of times but all that i received was an email that the complaint is being looked into nothing after that. Will try and send a legal notice but after that consumer forums are tough. The litigation is complex to draft replies and responses, hard to do it on our own more

It is the period lying with them and taken for repairs is to be extended by the company.Send them a letter by speedpost stating the same,if they desist then tell them that a Notice will be filed in the Consumer Court,the company will do it. more
