RWA violating guidelines

We had purchased a flat in greater noida in 2015 and though we don't live there it seems the society RWA management is encroaching on the rights of the owners. Certain cars are not let in easily, they don't issues stickers when asked. similarly, elections are not conducted fairly, rules changed without approval in general body meeting. no invitation is sent to residents regarding general body meeting.

Who should the residents go to sort this matter? Some people say DM should be able to intervene, some others are suggesting getting deputy registrar in meerut involved. Should we involve a lawyer? Are others esp in Ghaziabad, Noida Greater Noida facing such issues? What have you done? Please share your thoughts. more

Yes - Registrar Of Societies will regulate. more  
In case there is some mischief, then contact the Registrar if Societies. In case of other problem then file an FIR. more  
RWAs are governed by the Memorandum or Articles of Association filed and registered with the Registrar of Societies (if it is registered under the Societies Registration Act, 1860) or other concerned Authorities. The constitution of members, managing committees and other functionaries of the Society, their election and tenure, conduct of AGMs – all are set out therein. The Registrar can take action against Societies violating the rules on receipt of a complaint or otherwise. Similarly, the Magistrate can also intervene and facilitate conduct of a fair AGM or elections to Governing/Managing Bodies in his presence or in the presence of his authorized representative(s). Here again, all depends on the integrity and reliability of the officials. If the deputed person also colludes or sides with the culprits in a clandestine manner, then one will have to resort to other legal measures. As regard to the right of allottees, all have equal right over the common areas. None can block the right of way to one’s dwelling unit. Entry of vehicles to the premises should be limited to one for each flat. Otherwise, it will eventually create problems of parking with each flat owner parking 2-5 cars in the premises and eventually claiming right over it. In fact, the parks, parking slots, internal roads and all other common areas in a residential premise are governed by the Civic Body’s bylaws and the layout plan is approved by the Civic Body at the time of approval of the drawings. I stay in sector 20 Noida and have faced a similar drama which took place in 2009 in my sector when RWA did commit violation of all by laws, collected illegal funds, kept no account and made saparate money from hiring of community centre and ran the RWA without election for 9 years. Reporting all these matters with proof to CEO Noida Authority and deputy registrar Merut did not bear any fruit till due to some other equation came when Govt wanted to pressurise RWAs to come in favour of ruling party that our case was heard and ordered for fresh election of RWA without any punishment to the defaulted. My Experience in the whole episode is:- RWA is unconstitutional NGO getting registered under chit fund committee. Not as cooperative society. RWAs make their own by laws and for violations of those laws there is no punishment for the defaulters. Even a gentleman raises issues, he have fight with self effort and own finances where as the crooks who are expert in making easy money with the support of corrupt officials keep on enjoying and remain in field to take control of RWA or FONRWa or CONRWA. Wrong is wrong and should be fought tooth and nail. more
