The then Skilled patriots wisely specified article 23 to 30 to promptly & safely address the Religion , Caste/race/sect , Community to have their own and to carry their own within the limited provisions set in the Constitution solely at the great concern of Fraternity with the meaningful UNITY IN DIVERSITY . 2. They also set 10 years breathing and stabilizing time to the Political rulers under legislature to thereafter meet the Directives of the public administration set under part IV . 3. Except for the Scheduled Casts and the Scheduled Tribes they did not cover any other Caste in any article wherever the issue of economic benefits/considerations or, the issue of Castes were mentioned/specified . This is only because the Scheduled Casts and Scheduled Tribes will not come out of their areas and the areas/places they live are such both Socially and Economically disastrous . This is why , the articles specifically earmarked that whenever and wherever it identified or , intimated even by a letter, the article 32 provides free legal entitlement even though it is through an outsider . 4. The issue of Religions and Castes though safe and secure with vested tolerance and practiced fraternity , THE POLITICIANS FOR THEIR VOTE BANKING AND SOCIAL BACKING AND FOR ILL-FULL WEALTH EARNINGS WENT BEYOND THOSE SPECIFIED IN THE CONSTITUTION . 5. THE HONOURABLE INDIAN CONSTITUTION HAS BEEN THUS DIVERSIFIED TOWARDS THE SELFISH GOALS OF THE THEN POLITICAL LEADERS OCCUPIED POWER SEAT WITH THE ABOVE RELIGIOUS AND CASTS LINKED SUPPORT BANK ADDING PERIODICALLY WHATEVER CASTE THEY OPT FOR THEIR BACKING SUPPORT . 6. Supreme Court also could not establish Justice due to the implications of NINTH Schedule weapon in the hands of Legislatures . 7. The Executive under the President if was separate with fully de-linked from Legislature , the Bureaucrats being the Servants in the hands of the Coercive, Shrewd and selfish Group of Legislators are now facing the music for the diversified carries of the Political Leaders of Power Back. 8. Sri Mahen Patle is absolutely correct in pointing the facts. 1. There were some findings of supreme court that the directive principles laid down in the Constitution are nevertheless fundamental in the governance of the Country and it shall be the duty of the State to apply in making laws and hence , peoples representation will be regarded by the Apex court with equal preference . 2. The then Constitution makers with a positive purpose specifically concluded the article for implementation of uniform Civil Code like the partly insertion of Rao's report that could be easily/fast concluded that day . It is true that they also did not wish to give-up the carry of Hindu Heriditary Principles . 3. The article 44 was obviously stipulated to maintain uniformity and equality which also arrests the so-called created discrimination amidst Religious , Casts and minority issues . 4. The implementation of article 44 will eliminate many inequalities , discriminations and even the unjustified application/ treatments 5. The issues of Hindu cast based benefits to those who converted to other Religions is only due to the application and extension of uniformity and equality . The continuance of such Hindu Caste based benefits to those of other Religions people even on conversion will be be legitimate under Uniform Civil Code . As other wise , in this mislead continuance , Hindu welfare applications are going to Christians and Muslims and their applications are not shared to Hindus unless Hindus are converted to their Religions . THIS ITSELF IS ABSOLUTE INJUSTICE and the act of Discrimination that is prohibited under our Constitution . Further , this only is making many conversion campaigns just for the Economically Backward though our Constitution strongly speaks of prohibition of any discrimination based on Religion , Casts , race , Sex , Economic or Social Status . 6. In 1993 itself , Justice Ram Nandan Committee submitted its Report on Creamy layer identifying the Economically Backward and poorest of the poor upon the directions of the Supreme Court Constitutional Bench . Based on the then Political Planning , only a limited portion of this Report was considered for implementation keeping aside the real Economic address that is required for the real enforcement of Equal application and Uniform Provisions . 7. The Poverty Situation supported with the Political Selfish Power thirst has thence been ruling for maintenance of preferential privilege using the Casts as bulky scoring Vote bank . 8. It is true that No State had its Capital in Scheduled Areas and No State had its District Head quarters in Scheduled Areas to perform the government stake share of bringing up a Socially and Economically Recognizable status . Astonishingly, the Supreme Court also still not finding out the ways and means of such brought up status other than Economically sound Status. 9. HENCE , IT IS INEVITABLE TO HAVE A DEEP THOUGHT INTO THE REAL PURPOSES OF THE ARTICLES AND THE SKILLS OF THE THEN PARTICIPATORS IS NECESSARY FOR PERFECT IMPLEMENTATION SETTING OFF THE LOOP-HOLES OR , THE MISINTERPRETATIONS . AND , THIS COULD HAVE BEEN POSSIBLE IF OUR EXECUTIVE HAD GIVEN SUFFICIENCY TO JUDICIARY . Even now, there is the need for the Full Constitutional Bench that has to clarify/define and confirm certain issues for perfectency. more
