Restaurant Service Charge enforcement not happening

The attached notification was issued stating that those restaurants who charge service charge will face tax scrutinies.

Was that just for announcement sake because most restaurants that were levying service charge are still doing so. can something be done please? more

it is not mandatory to pay to service charge they cannot compel the customer to pay the service charge. You can simply avoid paying that. you always have the consumer Court to go. a cheap way to address our grievance. more  
I have gone through the attachment it again. Whatever points they have covered in the notification "THESE ARE GUIDELINES AND NOT THE LAW". And on that basis Owners association put the argument in court that guidelines is not a law. And we are not bound to follow it.
Another most imp thing that What if service charge is mentioned in menu card or at the entry gate? Is it compulsory to pay then? And at this situation Can we file a complaint?
I want to lodge a complaint in court, but it was mentioned in menu card regarding the service charge And I red many articles/threads regarding service charge but its not clear yet. wheather we can deny paying service charge if its mentioned in menu card. Once I get clear that we can deny in this situation also, I will go to consumer court for sure. more  
Our governments are good for making orders, but implementation will never done giving excuses if complained. Just watch how many acts are passed or orders passed even by supreme and high courts are not considered in any place for which even the courts are mum. more

Service charges can not be demanded by the Hotels and restaurants. In case such instances are since, it should be referred to the Ministry of Consumer's Affairs Department for taking necessary action. more
