PF Amount Receivables

My mother worked in a school for close to 25 years. She resigned in 2004 when she was aged 56 and expired in 2006. I was told I wasn't eligible to receive the amount in her PF account since she hadn't nominated anybody. Also, I was working and 27 yrs old only male progeny. Can somebody explain what the actual rules are and assist me please... more  

In the absence of nomination legal heir is eligible to receive the provident contributions. Since you are working and above the age of 25 you are not eligible for pension. Obtain legal heir certificate from the competent authroity and submit it along with Form 20 PS and Form 10C. You will be eligible to receive the PF contributions. When your mother resigned, had she not applied for withdrawal of PF contributions? When she was expired in 2006, (your probably 17 years of age) none of your relatives was able to guide you properly. You did not mention about your Father? What is he doing? When she started employment, whether she was married? All these will come up. In case she got married after joining in school as teacher, had she not filled up the nomination form? If so, how the school authorities submitted Form-2 without nomination? However, you are eligible to receive PF contribtions once you obtain legal heir certificate. In case you father is alive, and he was her nominee, he would be eligible to receive. more  
you are 100 % eligible. Follow the procedure to get this. 27 years is a long service and you should not loose that. more  
Please refer to Form 20 of EPF Scheme 1952, which clearly states that a legal heir is also eligible for PF amount accumulated in the account of the employee, in the event of his/ her death, in case such an employee has not nominated any one for receipt of the amount. The onus of proof to this effect lies on the claimant, by producing legal heir-ship certificate from competent authority. more  
YOU HAVE TO TAKE SUCCESSION CERTIFICATE FROM THE COURT TO CLAIM THE PF. more  
First you should get a legal heirship certificate notified in gazettee, then with the same youcan approach EPF department and prove that you are the legal heir of the deceased. If they are not willing to give then you will have to go to court. more
