No Ban on contestants with criminal cases in election - SC verdict

It is a very disappointing situation with SC not interfering in election contestents eligibility criteria. It is very desirable both for public and governments to elect people who are clean in to elected offices like panchayats mandalas , zilla parishad, Assembly, parliaments .
For the last 70 years it is happening that criminal elements are being fielded by political parties ,even staying inside jail and winning .Scheming from jails for their win with mobile phones , hench men , communication facilities, luxurious food, TV sets is a norm in our country.
It is making a mockery of democracy .
The election commission, the parliament must pass a bill that untill the cases decided, they are not eligible to file nominations.
The basic educational qualification also must be ensured for all posts .The benami husbands , PAs are welding power on behalf of these uneducated members which is like a mafia in reality.Corruption is breeding due to this under our very noses.
Fast track courts for offences like rape and murder cases, economic offenders and traitors, drug peddlers , gun runners, anti national activities like spying, planting of explosives and weapon smuggling must decide and indict them .Rest can be kept on probation after election with out voting rights in elected bodies.
Maximum age limits ,health fitness must be defined to contest.People with major dusabilities must be excluded from contesting.
A quick solution must be offered to the much exhausted citizens of this country to elect good representatives for governance. more

SC is not empowered to step into the territory of Election commission and Parliament unless something is against basic constitutional provisions. Govt should bring a law for this fast. Present govt has the mandate to affect this change. more
Infact, Preamble guarantee :Justice, Social Economic and Political do basically mean that the Ruler shall not be a convict on Fiscal Crimes and Social Offences.
This is enough to win Justice in the Full Bench of Supreme Court. Conviction due to Political Protests is different from the very Criminal Concept. more
This is now needed to be fought making it as Election Issue. That could only be the solution to teach lesson. more
Punishments on IPC 171 I and J need to be 100 times more. Others be set for 3 and 5 years imprisonment. Crimes are so multiplied . more
With this, S.C. reserved the issue of Political Contestants to [1] The Authoritative E.C. [2] The Empowered Parliament. Both together with Constitutional Bench of S.C. need to re-visit and review the guarantees confined by Dr. Ambedkar in Constituent Assembly opon which only the issue of Political Democracy was adopted. The particular, specific, eventual discussions recognized in the Constituent on this issue had not inlcuded any right or authority for those Convicted on Financial Frauds and Social Offences/Crimes. There is also the need of National Law Commission as well as the Bar Council of India to discuss deeply and specifically on this vitally important top most democratic issue in terms of JUSTICE AND MORALITY . Being dedicated Citizen, we need to sincerely move this issue:- A. In the National Law Commission B. Indian Bar Council C. Constitutional Bench of Supreme Court demanding a Joint meeting of Both the Houses of parliament at the interest of the Nation as well as at the interest of general public on this issues that has been ruining the very principle, motto and commitment of a People's Democracy. more
IPC 378 to 462, offences against property, 143 to 160, Offences against Public Tranquility, 171 E TO 171 J, offences relating to Elections , had been set aside and, Still the Constitutional Bodies if do not prefer Reforms in Electioneering, E.C., Political Parties, Performance of Elected Members, IT IS GROSS INJUSTICE NOT ONLY TO THE VOTING CITIZEN BUT ALSO TO THE NATION.
Hence, Reforms are must . more
