My builder is claiming for recovery of GST amount.

Dear All,

I live in an affordable housing society under PMAY in Gurgaon for the past two years. Maintenance is supposed to be free for five years. Builder has increased CAM charges twice within the last two years and again has increased from August without discussing with residents. They are saying that GST was not claimed by them these last two years from us and so now they want to recover it from the residents.

Can we claim GST for previous years when financials has been closed? Once paid TDS is claimed back by the builder. Also I read under RERA, GST is charged by the government for maintenance charges for only above 7500 per month per flat.

Ours is an affordable housing society how can we fight this builder as residents are not able to pay high CAM charges.

Another thing the builder wants to charge water charges of 300 per flat per month. We have still not got the government water supply. Is this correct?

Please give me your guidance in these two issues we are facing. Thank you more

Builder in all cruel cases take the advantage of signed and registered document. Normally common man is perfectly trapped by builder :1) they ask for booking amount, certain slab amount time to time. After such collection, they go for registration and buyer has no option than to register the documents with conditions mentioned in agreement by builder like he can make changes as and when required in buildings. Keep important work pending for years together. Again if society is not formed and if the building is still under builder then he will dictate his own terms. On top of it ,if building collapses, flat owner can not claim his flat , because conveyance is not done. And hence the land is still a property of builder. Earlier they used to misuse MOFA act. Now it is almost abolished. Hence RERA came in existance. Still unity of society member is must, to fight unanimously against the builder if the orders of RERA is no executed in given time. To file police complaints, follow up legally , a unity is must. more  
No we don't have RWA as it's maintenance free for five years. Thank you for your inputs more  
I dont think that anyone can claim the GST for the previous year from the consumer. Do you have any Resident welfare association? If not, then you may approach Haryana Real Estate Regulatory Authority (HARERA) for clarification or making a formal complaint. You may have to include more resident if you need quick actions.
