Mobile Insurance Cheating - Apps Daily

I purchased Samsung Handset and Apps Daily insurance as a safety cover. Accidently I dropped the phone and broke the edge of the phone. As it was hardly 3 months old handset and well covered under Insurance I submitted the handset for repair on November 16.
Till yester neither have I received any reply from the company Apps Daily nor have I received my handset. Yesterday they called me to inform the spare part is not available and I have to get the repair done from market.

I am sceptical if they would pay or not as they took 4 months (commitment was for 45 working days) to reply. God knows how much time they would take to pay for the claim.

Can someone guide if I can file a complaint against the company in consumer court. If yes, kindly guide the process too.

During the warranty period, the manufacturing companies are taking the products with defects and after a long time returning the same with manageable repairs. more  
If you make a claim ,say under mediclaim policy ,your full claim will never be sanctioned by any Insurance Company. Very few people approach Consumer Court to redress his/ her grievance. Others who do not approach Consumer Courts will not get their rejected amount of claim. So Ins. Co. stand to gain even Consumer Court makes an order for payment of rejected amount of claim by few consumers. This is the modus operandi of all Insurance Companies. Rasik Dagli more  
Consumer Forum is only best solution among all others including Civil and criminal for cheating. But if you opt all of them - I assure that you will get the response and remedies very shortly. The service providers well knowing fact that conman man is reluctant to enter in to this fray, but when there very individual responsibility at stake it pulls them from their conditioner seat. more  
my suggesstion will be do not do insurance with private parties pl get it done thorough the GIIC cos i.e govt owned ones. in case of govt owned cos one can go to higherups right up to PRESIDENT OF INDIA and all names of higher ups given in their web sites but in case of private cos no details of higher ups given. this has been my experience. m.das more  
All insurance companies in India are fraudsters who are govt. and judiciary backed too. So you will lose. more
