Is something wrong with Justice Delivery System?
HC increases rapist’s jail term from the original 3 yrs to 7 yrs.
MUMBAI: More than 28 years after a man from south Mumbai was accused of raping an “adolescent” domestic help and 14 years
after the trial court delivered a guilty verdict.
As the man was out on bail, the HC said his bail bond stood cancelled and directed him earlier this month to surrender by January 4.
It took 14 years for trial court to deliver guilty verdict and another 14 years for High Court to pass an order.
In the mean time rapist was out on bail for 28 years.
Now he will approach Supreme Court and may be it will take another 14 years for delivery of justice to rape victim.
This may be the reason why rapes are taking place every day as there is no fear of Law.
This lacuna in justice delivery system needs to be corrected by suitable amendment to Criminal Procedure Code. Some suggestions are:
1. Police to be sensitized to file FIR in rape cases without any delay.
2. Rape should be made Non-bailable crime.
3. Time limits to be fixed for investigation (4 weeks),
Trial Court (2 weeks), High Court (2 weeks) and Supreme Court (4 weeks).
4. If death sentence awarded then time limit of two weeks for mercy appeal to President.
5. No review Petition to be allowed in Supreme Court.
