Payment of Service charges are said to be optional and to be decided by the customers who have the discretion to decide as to whether to pay and how much to pay. Hence it is you to decided while paying. more  

Charging Service Charge has not been declared illegal by regulating authorities and therefore, no question of levying penalty on anyone for charging Service Charges. There is a need for declaring charging Service Charge illegal first and then taking action against offenders. more  

Why Restaurants or Hotels are bifurcated to giving the Service & hence charging the Service Charges? As if only Hotels/Restaurants are the only ones to provide service & Doctors/Engineers/Tin Makers/Earthen Pot Makers/Plumbers/ Painters /Electricians/Tailors etc do not give service to the masses. Every profession more or less in its own terms is to provide the service to another person or to another entity. Then why this exception. Already people were giving tips to the waiters without the knowledge of the Owners. Now the owners want to know how much Tip (Service Charges) & they will decide how much is to be given to the waiters? Also the customers will not know how much amount the owner has given to the waiter? The retained amount by the owner is clearly coming under corrupt practices. On the part of the Government there is a serious mistake of not clarifying the clause & writing it as if you wish to pay. We do not want to but we are forced to pay. Whether one likes the service or not the Service charges has to be paid. Earlier the TIP Concept came from foreign countries which meant "To Insure Promptness". This was when the person visits the same place again he/she wanted to get prompt service without waiting for more time to be wasted. more  

So far my knowledge goes, while introducing the Service Charge, no checks are put for controlling the mischief mongers. Now the government may consider some restrictions, due to the hue and cry of the public. more
