Help needed related to closing company having pending GST penalty

Hi, I am looking advise/suggestion on the following problem. I had started a tech startup 3 years back. I failed to create a sustainable business and now moved back to corporate job. I have filed GST till February 2018 but after that I have not filed GST. Now the penalty has accumulated to approx Rs. 1.2 lakh. As per the CA, to close the company we need to clear the pending penalty. Currently I am not in a position to pay the penalty since there is other debt which I am clearing through new job. What are the available choices to shut down the company with less or no penalty ? more

There is AMNESTY as well as foreclosure provisions. Your matter can be fitted to it, instead of letigations to prolong further. more
The matter can be addressed with the facts, Asume you have discontinued your business and that there is no transaction and all you have missed out is filing nil returns. There is no late fee for filing GSTR1 for 3B the same will need to be evaluated period wise as these were waved for certain period. There is not clarity on the nature of income and business. Would request to share the facts on whether any liability was due and remained to be paid or there was no income only delay in filing the reurn. Whether any notice has been served or you have information only from your CA Larned colleagues can help only when facts are disclosed. more
Dear Santosh please let me know when you have discontinued your business and when you have given intimation regarding closure of business as you have to file your GST returns upto that date only and accordingly Late fee will be calculated. Please share your complete details with me either on phone 9899390850 or through mail. My mail id is adv.sanjeevgoel@gmail.com After receiving your details I assure to help you in the best possible manner. more

Hi Santosh Shet In case, you had nil sales, there was a Notification of GST for closure of business, by cancellation of registration without late fee. Please request your CA to refer the notification and get your registration cancelled. Since he has all the required details, he should be able to get this done. more
