I would like to know if we need to charge IGST on Engineering Services rendered to other countries (USA, Germany, etc) or need to issue an invoice without GST? During Service Tax regime, we are fully exempted in paying service tax on these services. more
As the place of service is outside India, no matter of charging IGST. It will be treated as zero rated export of service and ITC may be refunded if there is not any export duty. more
Dear Nagesh, services rendered outside India is treated as exports and so u dont need to charge or pay GST. Similar was the provision under service tax also, since the services are rendered or supplied outside the taxable territory. U have to follow the provisions of exports under GST by executing a LUT or Bond and the remittances received to be in freely convertible foreigen exchange. more
Nagesh, I am bit surprised if you were not paying Service Tax on the services you had extended in the past. Perhaps you were not covered under service tax owing to lower service cost (below Rs.10 lakh). I have been paying service tax on the services extended to an European company. Please check once again. As far as I understand, GST will be applicable to you and your client may not take the liability of the same. more
The rules envisage that the receiver of goods and services, abroad, from India would NOT be charged to GST. Simply because the final consumer is not within the taxable jurisdiction of India. In the case of INWARD goods and services, GST WOULD BE CHARGED. best wishes. more
