GST has Become Colonial Taxation System

Confederation of All India Traders (CAIT) has said in a press release that Much against the declared spirit of GST as Good & Simple Tax, the GST has become a ‘colonial taxation system” quite away from the ground realities of business conducted in India.
Various recent amendments and introduction of Rules under GST has made the taxation system much complicated and put much compliance burden on the traders, which is also against the vision of Prime Minister Shri Narendra Modi for bringing ease of doing business.
In a recent Rule, the GST Authorities have thrown all canons of natural justice by empowering the Authorities to cancel GST Registration of any trader without giving him any notice or an opportunity of hearing. Unfettered and arbitrary powers are given to officers without realising the misuse of such powers which may lead to corruption. The GST law has been greatly distorted by the Authorities which is evident from the fact that since the date of GST implementation till 31st December,2020, total 927 notifications have been issued, in 2017 298, in 2018 256, in 2019 239 and in 2020 137 notifications. In such a situation how can we expect from traders to comply with timely compliance of the taxation system. more

Right now I feel we are not a democracy but an autocracy with government officials being at the helm of issues, be it the police, the municipalities, the GST officials, the men who are government servants, all these lord it over the middle class and the poor public. There is no justice as it takes years in court and there is no one to really hear us. Mr. Pande and I have been continuously stating that GST for societies is wrong; but no one will hear us. 18% GST for medical policies for senior citizens is a loot but no one will hear us. Surely the PM knows what is going on. The Local Circles manager needs to bring it to his attention. more
With GST, most of the traders who had been avoiding various taxes have come under tax-net. Thus all these oppositions. Unfortunately most of the state finance ministers who were made members of 'Empowered Committee' had never done home work, but only enjoyed meetings at 5-star hotels, in various hill stations, sea beaches & tourists destinations. When GST was implemented, various oppositions, practical problems cropped up and in every monthly meetings add-on decisions are coming, thus various confusions. By these process, standardization will come. Just don't try to make a mole out of hill. more
Yes, We have nothing to express other than our emotions. I have written these few lines after experiencing humiliations/ridicules for expectations of justice for unlawful, unwarranted/high-handed activities activities. Therefore, if you think that you would be dispensed justice in reasonable time by approaching a court of law - is only theoretical nor practical. more
I agree with Mr DK Sarkar's sentiments expressed in the last line of his post. more
Mr. Rajeev Arora is only emotionally driven, neither theoretically nor practically. I had written in several postings of this circle - that the GOVT. SERVANTS ARE ASSURED OF TOTAL IMMUNITY. What will happen to them if taken to Court? Court will pass some order which would be only of archival value and/or some monetary penalty, which would be paid not by the delinquent /hardened official, but by the Dept. concerned i.e. by the Government. From where the Government gets the money? From various Direct/Indirect Taxes/Cess, etc. paid by Mr. Rajeev Arora, D.K.Sarkar, Hon'ble Judges of such cases(!) ,and others. All readers/ members/ non-members of the Local Circle are included. Thus, Govt. servants are refractories to being penalised, getting strictures, reprimands, etc. Govt. servants have all reasons to rejoice. more
Trying to understand your first comment "...only emotionally driven, neither theoretically nor practically". Appreciate if you can elaborate. more
Most of the businessmen themselves are not honest and therefore they avoid taking a "Panga" with authorities. more
