One of my client obtained GST registration but didnt file returns as he has no running business. Now he was gettinh notices for not filing NIL GSTR3B returns . When logged in to GST portal fof filing NIL returns.. per return per day RS 20 fine amount shown. So approximately for 11 returns he has to pay more than Rs 30,000. He was not aware of fine amount. He doesnt wamt to pay as he has no running buainess .So applied for camcellation of GST. But GST authorities refusing to canel registration untik all pending GSTR 3B returna filed. Is there anyway to avoid this huge penalty and getting cancellation of registration?. Please help with relavnt rule and sectio in GST law. more

Proper officer can only approve the application for cancellation of registration only if no Government dues is pending to be recovered from the taxpayer. Better to pay late fees, file returns and apply for cancellation of registration. more
One principle need to be remembered. The winding up operation is much more difficult than opening up of. This is true that you need to clear all dues before opt to wind up. The GST authorities are and cannot be aware on its own that you have nothing to pay unless and until 'NIL' returns are filed. You might have to file a petition before GST authorities and represent yourself with facts and documents or else pay the penalty for delayed filing of returns and wind up the operation. more
