Getting hit by someone on road

if someone is going on the road and another vehicle hits them, what does the law say should happen in Delhi.

Who determines who is at fault?
If i have been hit and not at fault at all, can I demand the other guy who hit me pays for the damages incurred.
What is the police and legal process?

I would like to hear from peoples experience and Delhi Police on what shud one do.

If someone hits my car in a foreign country, their insurance company does the whole survey and pays for my damages. Their premium then increases over time. more

Please remember that the person who hits from behind is always at fault and not the person who is hit and is going infant. Side hitting is debatable. more  
I myself is a victim of hit and run. The accident at 25/05/2015 but no information was given to police station by the hospital Neelkanth, Gurgaon, Haryana. I was suffering from memory loss for three months. I FIR on 19/01/2016 and no lawyer is ready to help me. Thanks for your post. more  
If you are prepared to pursue the matter with the Police and go to Court, the Court will determine who is at fault, penalise the guilty and compensate the victim. I did it in one instance involving a drunk driver at 6.00 pm!!! But it needs perseverance, time and effort - at the Police Station and at the Court. more  
An accident on the road probably is not a criminal offence, that is the reason it's called an Accident. There is no reason to start fighting and a blame game. The first priority is treatment of the injured, everything else is secondary. Park the vehicles on the side, inform the police and click photos on the site of accident. Most often to avoid the police we try settling the issue ourselves by fixing the blame. Road accidents are covered under the MACT and handled by a separate court more
