Fraudulent activity from Xiaomi

I ordered one Mi 3 band having order no. 5190929802404425 , but whatever product I received, was not fresh/ new product.
So, I askes for refund .
But , inspite of refund, I again got the same product, but this time accompanying charger was missing .
I already had emailed many times to u people for the same , but whatever response I got , is very pathetic and disappointing .
Service executive repeatedly giving the same excuse that , Xiaomi had sent fresh new intact product.
But whatever I received was not fresh product.
So, clearly it may be the problem from Xiaomi or from the courier agency side .

So I want the best needful result for the earliest.

Please issue one notice and proceed with consumer court and save time more  
It is a common thing in such cases, so we should personally buy from store high value products. more  
Since last 8 years I have been buying items online. Since beginning I have a self made rule, not buying any article more than a particular value e.g. more than 1000 rupees. This saved me lot of trouble. No mobile, computers and electronic items. This rule had saved me from getting cheated by dealers. Most of the ecom portals are just service providers to all kind of dealers. They collect their commission from dealer and are not bothered about quality / quantity of product supplied to customers. more  
Better to move at consumer forum and case against the company. more  
What's the point to raise here? Is there any way to prove the product whether it is old or new? You may be correct but such logic no one is willing to accept. It's always advised not to be much motivated to purchase on line such product as consumer circle gets a complain of buyer in every week. It's good enough to visit an authorised dealer's outlet and purchase it, it enables one to have the right product. Online marketing agencies are not authorised dealers at any cost. Please remember it. No consumer forum will entertain such complains, so it's better to deal with the concened agency only. more
