For extensions and projections booked by MCD, can Central & State Governments provide some relief ?

Since 25 January 2006, Municipal Corporation of Delhi (MCD) puts the list of unauthorized and illegal constructions booked on www.mcdonline.gov.in. This happened after Delhi High Court asked MCD to make the list public so that those planning to buy houses or shops can check the status of the properties besides giving an opportunity to guilty property owners to remove illegal constructions on their own. There are more than 15,000 such properties in Delhi which are listed on MCD website. Important thing to note is that there are many more such properties in Delhi which should have been booked (eligible under booking criteria) but have not been booked by MCD. Even Rent Agreements (leave aside sale, transfer, or any other deed) cannot be registered for properties booked by MCD. Also note that this is different from the unregularized colonies issue.

Injustice has been done to those people who have not done any extension on the government land but made full use of the space that they own. Most of these properties are booked under the Projections criteria. Since 2012 (after some MCD commissioners were charged and jailed by Supreme Court), the expense of getting a booked property regularized by MCD is beyond the reach of most of the middle class people who build their houses once in a lifetime. If we look at the number of people and the impact (in terms of expenses, and legal limitations), then this is a serious issue for both the Central & State Governments. Advantage here is only to the Property Dealers who use their influence to buy such booked properties at cheaper prices.

Can the Central & State Governments provide relief to these families (more than 1 Lac people affected directly or indirectly) whose properties are booked by MCD (especially under Projections criteria) ? Please advise. more

Unless human beings are repeatedly taught about the duties , responsibilities , the need of neighborhood , compulsory honor of the Rules and Regulations , even with fit punishments and Fines , there will not be any wise and shared living attitude . Therefore, as long as the political governments carry , the human ills will carry . As long as the Constitutional Government rules impartially in a perfect and acute way , there will be the continued Honor on the Rule , Sharing the Neighbor , Social Awareness , Social Nature and ultimately the Social-binding . So, recollecting the earlier discussions on the above subject , the Supreme Court shall be approached enlightening the need of a permanent Solution since the Real Estate Mafia is backing behind . more

GOVERNMENTS WILL HAVE TO REGULARISE MINOR ISSUES IF THAT LOCAL AREA AND ROAD TRAFFIC , CONGESTION , PERMIT. IN THE OTHER CASE OF NON-PERMISSABLE STATURE , EXEMPTIONS WILL NOT BE POSSIBLE THOUGH MCD AUTHORITIES DID NOT CARE AT THE TIME OF RAISING EXTENSIONS AS YOU AWARE PLEASE. more  
Our house was booked by MCD stating "U/C of GF, FF & SF along with projection on Municipal Land at side and rear side back lane at GF, FF & SF". In reality, the facts are, - Ground Floor has 100% coverage (no extension at all). - First and Second Floors have projections of 3 feet but without any support (no pillars from ground floor, nothing) at all. - There is no parking provided as this property was constructed in 2010-11. - Plot size is hardly 84 square meters. If Delhi has 100 such houses, then why only 1%-2% have been booked by MCD ? At least for these smaller plots, who did not make any major projections/extensions, the state government should provide an option to pay a penalty for not making any structural changes. This will help add to the state government's revenue without any loss of Municipal Land. Those who cannot pay the penalty will obviously be forced to make the structural changes and then get their properties regularized. Note that I am talking only about properties booked for MINOR Projections. Regarding our case, when we approached MCD people (commissioner level people), they guided us that it could prove quite expensive (including bribes as and when required) to get the property regularized. And that too is a partial solution, because they cannot remove from the online database, without structural changes. Until the state government changes regulation for all booked properties in Delhi, even those booked for minor projections will equally suffer. When we asked why our property was booked, they said it is all a matter of bad luck. MCD officials randomly visit and book any property as and when they feel like. It was disheartening because our floor plan was the brainchild of architect, who was pretty sure (at the time of construction) that nothing would ever happen for minor projections because first all those properties having major projections would be booked. We changed our floor plan twice (during construction) trying to reduce the coverage at best. But today we stand against MCD with only hope and nothing else. For resolving this issue of Minor Projections booked by MCD, in my opinion, below steps should be taken, 1. For smaller plots (less than 100 square meters), 100% coverage should be allowed without penalty. 2. Minor Projections should not be booked in the first place. There has to be a minimum criteria for booking. And to prevent Minor Projections, an alternate rule (imposing hefty penalty without structural changes) should be implemented. 3. For Major Projections and Extensions (whether Minor or Major), structural changes with penalty should be imposed. more
