BUILDER NOT REFUNDING ASSOCIATION FUND
WE ARE FACING THE PROBLEM OF GETTING THE ASSOCIATION CORPUS FUND FROM THE BUILDER IN CHENNAI, FOR WHICH THE BUILDER HAS GIVEN RECEIPT AND ALSO STATED IN THE CONSTRUCTION AGREEMENT. MORE THAN A YEAR OVER, IN SPITE OF OUR REGISTERED ASSOCIATION RIGOROUS FOLLOW UP. WE ARE 50 MEMBERS IN TOTAL, MIDDLE CLASS MOSTLY YOUNG PROFESSIONALS AND SO IN A VERY CONFUSED SORROW SITUATION, KNOWING WELL HOW STRENUOUS AND TIME CONSUMING TO MOVE LEGALLY ETC. REQUEST CIRCLE MEMBERS TO SUGGEST MEANS SO THAT BUILDER IS FORCED TO COMPLY HIS COMMITMENT OF REFUNDING OUR CORPUS FUND more

We, in Chandigarh are living in a complex of 168 apartments, developed by a private builder and the land sold by open auction by Municipal Corporation, Chandigarh. The builder got approved the construction of 192 (including 25 EWS apartments) and told the buyers for only 168, thus hiding the fact that there are 25 EWS apartments also. Later the builder sold these 25 EWS apartments by adjoining with 2 BHK apartments as 3 BHK apartments. Since then, we all are facing problems and the builder is not paying back more than Rs. 3.00 crores since last five years. Please suggest what to do. Thanks. Chander Mohan Goyal more

Swetha, 1-i m of the opinion write to chief justice of India, if you want to resolve the case 2-why this permission to builders all over country? so all over poor are sufferers. 3-why they are tied up with Rule, laws, regulations, why small individuals have to suffer? 4- Quote Maharashtra Mumbai, worli area, coca-cola factory scams? a registered documented apartments are made to suffer . it was 40 years before built up. 5- the banks were parted with financed the flats, but there is no scratch for builders? 5- Ask are we going to live for your justice which you might deliver after death? 6- Leaders, system, corruption is main cause to it. 7.. we are getting stand up situation thr' app. hope for the best. v. sorry. but legal proceedings as per law one has to take, at present. there is some system our p.m.have initiated little hope before death one can see. more

Legal action against the builders could only force them to refund the money with interest and damages together with expenses. more
