LTCG in Penny Stock and harrassment by Income Tax Department

The Income tax department are issuing notice to general public who had claimed benefits w.r.t LTCG and on the basis of argument that the stocks dealt with are penny stocks.

The department should have right to ask the assesses about their Tax and their details. But not things which are beyond their control i.e How the general public would come to know whether the stock is penny or not ?

If such things are there then they should stop the trading of such scripts from exchange itself in order to remove the problem from its root itself.
