This is not the first instance when the RWA President of Carlton Estate has used un-parliamentary and foul language towards the residents of Carlton Estate – a residential society located on DLF Golf Course Road , DLF Phase 5 , Gurgaon.
“For the said President of Carlton Estate, it has become a standard and routine practice to address the residents with such low, uncivil and disparaging language.”
“Residents say, Jain is an uncouth ,brusque and uncivil individual who has been made the President of Carlton Estate.”
As a matter of fact , the said President is not an elected President of Carlton Estate. He was made the President after not having received any opposition from the members of the said residential society ; more appropriately termed as unopposed President and also not through the Veto Power of the members of Carlton Estate.
It has also come to light that , Jain in the recent past was removed from the position of Secretary cum Treasurer , a position held for obvious reasons and to the effect , the former District Registrar cum Joint Director – Firms and Societies , Gurgaon – S N Singh had removed Jain unconditionally.
In a recent plaint received against the said Carlton Estate RWA by (DTP) Town and Country Planner , Gurgaon – R S Bhath for initiating illegal construction of balcony drainage project in the premise of Carlton Estate , a notice has been issued to the said RWA to seek written response within 15 days with a stern warning that no illegal construction will be allowed against the Law or Act.
The said RWA Management without seeking required approvals from DTP , Gurgaon for the balcony drainage project had in the month of October , 2018 illegally issued invoices towards the residents and demanded consolidated amount to the tune of Rs.25 Lacs approximately.
As per residents , there has been serious allegations leveled by the residents of Carlton Estate against the said RWA for misappropriation of funds and to the effect it is alleged that there is no transparency in the books of accounts.
“Whenever any resident of Carlton Estate dare to raise voice against any such financial irregularities seeking transparency of books of accounts, the said President stoop to the most vile, appalling and abhorrent form which is time and again condemned by the residents.”
Recently , a group of residents who dared to challenge illegal acts of the said RWA were exclaimed as Idiots by Jain vide repeated E mails shared among the residents and also vide an internal Circular put up on the Notice Board of Carlton Estate with deliberate intent to malign and bring disrepute to such righteous and upright residents.
“In the recent past, residents were shell-shocked to have received a communication from Jain that despite any such plaints filed by the residents against the said RWA, Jain would be utilizing the funds from the residents towards all legal expenses to be incurred to further defend such plaints/ cases before the competent authorities.”
In the recent past with deliberate intent to extend his term as a President to further inflict mental agony and exploit the residents of Carlton Estate , Jain on the pretext of making amendment in the Clauses cited in the Bye Laws of Carlton Estate approached the Office of District Registrar to amend such Clauses by citing Grounds such as “Contravention of Fundamental Rights in a Democratic Set up and HRRS Act 2012 by misleading the residents got the said Clause approved however as matter of fact , District Registrar , Firms and Societies , Gurgaon was apprised about the said ulterior motive where-in , such irregularities were brought to the notice of the said District Registrar without any delay to seek urgent intervention in the matter.
Clauses in the Bye Laws of Carlton Estate are Read as Under :
A. CLAUSE No. 21 (iii) and CLAUSE No. 22 (i)
“As per this Clause , term of the office of the office bearers shall be 2 years , however Carlton Estate Condominium Association Management is proposing to amend it to 3 years.”
B. CLAUSE No. 10 (iii) – DISQUALIFICATION
CECA management is proposing to delete the said clause which is as under : “Any members elected to the Governing Body shall not be entitled to contest for re-election , after having served in last two consecutive terms as member of the Governing Body.”
As per Carlton Estate Condominium Association Bye Laws and HRRS Act 2012 , amendment of the Memorandum and / or Bye Laws of the Association can be amended only through a Special Resolution at any general Meeting , Annual or General , which is attended by at least 40% of the members and the proposal is approved by 3/5th of the members present and voting.
Plea filed in the Office of District Registrar, Firms and Societies, Gurgaon :
As minimum quorum required is 40% for amendment of Bye Laws and as less than 10% of total registered members were present in the AGM held on September 23 , 2018 the amendment being proposed by Carlton Estate Condominium Association Management is totally illegal and should be set aside and not approved under any conditions/provisions.
Besides all such irregularities alleged to have been committed by the said Carlton Estate RWA , residents have time and again leveled allegations towards the said RWA for wasting lot of money of the residents on the road re-carpeting project and through the poor quality / sub standard material used where-in the condition of the roads is in shambles and residents fear to be once again receiving demand for re-carpeting of roads as the said roads started breaking within 6 months after completion of the said project with cracks visible from bare eyes and the said RWA has furnished explanation to the residents by saying that , “Even roads break on the highway and require repairing so roads in Carlton Estate are no different.”
As a matter of fact , despite repeated requests made by the residents to the said RWA to comply with the norms of floating a tender in at-least 2 print publications , the said RWA by disregarding such repeated plea arbitrarily moved ahead and all the more destroyed the roads of the said residential society located on the Golf Course Road , Gurgaon.
Furthermore, as a matter of fact , the Estate Manager of Carlton Estate – Alok Kumar Srivastava is a former employee of DLF Ltd who’s monthly emoluments are more than 85,000/-.
In the recent past , former District Registrar , Firms and Societies , Gurgaon – S N Singh had issued Suo Moto Notice to Srivastava for receiving his Salary concurrently from two employers ; from DLF Ltd and Carlton Estate Condominium Association.
The said plaint is yet to be disposed of by the District Registrar against Srivastava.
“Despite , repeated requests made to the President of Carlton Estate – Sachin Jain to forthwith remove the said Estate Manager of Carlton Estate – a former employee of DLF Ltd, Jain has turned deaf ears to such repeated requests made by the residents and as per residents, Jain is alleged to have been loyal to the builder – DLF Ltd and not to the residents of Carlton Estate.” more
