DLF Accused For Planting It’s Employees As Part Of A Conspired Design In A DLF 5 Condominium

DLF, a developer based out of Delhi / NCR, India also known as Delhi Land and Finance expanded it’s footprints in the middle of 1980’s with a business model to buy large chunks of land from the Government and thereafter traded such plots by selling it to the individual home-buyers.

Similarly , as a method to earn more profits, DLF spearheaded towards developing multi-storey high rise apartments in Gurgaon – a satellite town located within a close proximity to the Capital of India – New Delhi , where the Policy Makers and Bureaucrats define the frame work for introducing proposals to be implemented for public good.

In the 1980 decade, DLF was a dominant player in the Real Estate Sector and enjoyed it’s monopoly till almost 1995.

DLF developed a middle income group housing residential society ; Carlton Estate in the vicinity of DLF Golf Course by highlighting the presence of the said resort and country club to attract the home-buyers as a unique selling proposition strategy in the year 1999 which is now home to the residents with 484 apartments in the heart of Gurgaon.

The possession of Carlton Estate apartments after completion of the construction were handed over to the consumers in the year 2003 while, DLF scripted and authored the Bye Laws of the said society by compromising the interest and welfare of it’s consumers in a similar pattern where-in the past DLF faced lot of flak for scripting completely one sided, unfair, oppressive, unilateral, exploitative, draconian and abusive clauses in the builder buyer agreement of the Belaire, a residential society developed by DLF, located in the vicinity for which DLF was in the news for a long time for all wrong reasons.

DLF with nefarious design in order to have control of the operations and maintenance of the residential societies play a ploy to give access to it’s senior employees by making them a resident of such newly built societies where-in , it also keep it’s security guards with intent to have access to all such information of the residents as informers.

It has been a pre defined well thought plan to exploit it’s consumers cum residents for an indefinite period.

As alleged , V K Gupta , one such senior employee of DLF who is now Gurgaon City Operations Head cum Sr. Vice President was made to reside in one of the Condominium – Carlton Estate, DLF Phase 5, Gurgaon in the same year when the possession of Carlton Estate was handed over to the residents by the said deveoper. V K Gupta in collusion with DLF apparently became the President of the newly built Carlton Estate Condominium Association ( CECA ) and also inducted other board members and to the effect controlled the operations.

As a matter of fact and part of the larger conspiracy , V K Gupta in collusion with DLF was also made the President of other residential societies developed by DLF, namely Ridgewood Estate, The Summit and more with similar willful intent to commit all such irregularities.

During the tenure of the said RWA Management governed and lead by DLF, there was no transparency however the said RWA Management continued to control day today operations of the said society while illegal acts were committed by the said RWA President and it’s accomplices.

For a long time , Real Estate Sector was unorganized , unregulated and unaccountable to consumers.

After receiving complaints from aggrieved home-buyers against unscrupulous developers for deliberately continuing with the operations of the housing societies and plotted independent houses even after handing over the possession of the houses to the home-buyers with deliberate and willful intent to financially exploit them, the then State Government of Haryana took a resolve and in the year 2012 introduced and enacted a stringent law to protect the rights of the home-buyers which is known as Haryana Registration and Regulation of Societies Act , 2012 ( HRRS Act , 2012 ).

DLF in the year 2013 decided to handover the control of the operations to the residents of Carlton Estate after a Government notification pertaining to the HRRS Act , 2012 was ensued in the interest of home-buyers.

Unfortunately , the residents of Carlton Estate were still in the grip of the said unscrupulous developer even after the enactment of the said law and forthwith DLF found it’s ways and means to continue with it’s unfair and unethical means as part of it’s modus operandi to exploit it’s consumers cum residents.

V K Gupta despite having handed over the operations of Carlton Estate to the residents with ulterior motive preferred to be a member of the Board of Members of Carlton Estate Condominium Association.

By this time, DLF just could not have afforded to let leave it’s loopholes before the residents as DLF along with V K Gupta could have entangled in multiple litigations for alleged to have committed umpteen irregularities.

V K Gupta in collusion with DLF played another ploy to induct an erstwhile employee of DLF as Estate Manager of Carlton Estate to retain the operations through it’s right hand.

Alok Kumar Srivastava , who was made Estate Manager of Carlton Estate was previously employed with DLF as Deputy Manager ( Buildings ) and was also part of the erstwhile RWA Management of Carlton Estate as Vice President.

V K Gupta did not leave any stone unturned to manipulate and continued to commit wrongdoings in collusion with Alok Kumar Srivastava – Estate Manager of the said society.

As a matter of fact , elections were held and the loyalists of V K Gupta were once again fielded and became part of the new RWA Management of Carlton Estate.

Furthermore , in the year 2015 , residents protested and in-order to avail legal remedy were compelled to approach the office of District Registrar , Firms and Societies , Gurgaon under the ambit of HRRS Act , 2012 and the said RWA Management was termed illegal and forthwith dismissed by the then District Registrar – S N Singh.

It’s been more than 14 years that the residents of Carlton Estate are unable to come to terms with such repeated financial exploitation happening in the said society and are up in arms against all such illegal acts alleged to have been committed by the wrongdoers.

Residents have been time and again complaining for opaque and unethical practices adopted by the said RWA Management however to no avail , such irregularities continue to happen.

Residents of Carlton Estate in the last 14 years have witnessed umpteen financial scams to the tune of Crores and so far there is no respite from such shady conduct of the said unscrupulous developer who happen to control the said society by proxy.

Despite , repeated requests made by the residents to the present RWA Management governed by Sachin Jain – President , Nitin Gianchandani – Vice President , Sameer Nigam – Secretary , Sandeep Lamba – Jt. Secretary , Ibrahim Ahmad – Treasurer , Sunil Verma – Member and N. Harinath – Member to remove the Estate Manager – Alok Kumar Srivastava who happens to be an erstwhile employee of DLF and initiate appropriate legal proceedings against DLF and it’s accomplices for alleged to have committed illegal acts , the said RWA Management is most brazenly doing everything to shield such perpetrators from the clutches of law and instead abetting all such illegal acts.

At present , the scenario in Carlton Estate is so grim that residents who repeatedly raise their voice to seek transparency are intimidated and given all such facts , few residents have also termed the said society as not worth living in.

Interestingly , on further seeking clarification from the representatives of the said developer , often a dubious statement is issued which by DLF which says that ,

“DLF had in July , 2013 handed over Carlton Estate to the elected board and has no connection with Carlton Estate Condominium Association , which functions independently.”

“DLF has been time and again accused for adopting unfair trade practices and thereby cheating it’s consumers by not one but almost every residential society developed by the said developer which has further ensued a battle between the said unscrupulous developer and it’s consumers in different Courts and Government offices in the Country.”
